To me it means that if the information is really critical then it might
be necessary to provide one type/form over another to ensure comparable
access -- such as captioning text over video sign language or vice versa
depending on an individual's needs/ability to use each. Just my
understanding . . .

Here is a very rough draft of a new subsection for ?1194.2 Application
as we discussed on today's call. I did two forms as the list structure
seemed a bit awkward.

When determining if individuals with disabilities have access to and use
of information and data that is comparable to that available to
individuals without disabilities, each agency shall ensure that
individuals with disabilities have access that is -
(1) timely, which includes consideration of the speed with which a
person with a disability can use EIT to access information or perform a
task as compared to an individual without disabilities,
2) accurate, which ensures that the information and data reflects the
intended meaning especially when converted into another form or media,
and
3) in a manner and medium appropriate to the significance of the
message.

When determining if individuals with disabilities have access to and use
of information and data that is comparable to that available to
individuals without disabilities, each agency shall ensure that
individuals with disabilities have access that is timely, accurate and
in a manner and medium appropriate to the significance of the message.
Timely access includes consideration of the speed with which a person
with a disability can use EIT to access information or perform a task as
compared to an individual without disabilities. Accurate access ensures
that the information and data reflects the intended meaning especially
when converted into another form or media.
