Scrolling text is fine, as long as the text is not scrolling by default
(i.e. user has to start the scrolling explicitly), and that without
javascript (assuming that's what they're after) users can still access
all the information regardless.

Quick response:

1. they must provide a means to STOP the scrolling - some people will be too
distracted to read the 'real' content on the page.
2. it must not interfere with device independence
3. the items/information must all be available elsewhere for those who
cannot see the scrolling and those who cannot read fast enough and/or read
the provided text because of it (usually small) size.

From a design point of view its also very bad, its distracting for any
user, hard to read as it always blurs to a certain extent and the user
has to wait to be able to read all of the news items - meaning that
most news items wont even be read.

Its also a horrible reminder of the bad years of web
design/development when every website had a news ticker/scroller - you
rarely see them anymore especially in HTML websites.

100% ACK, they are tacky, and pose more issues than benefits. Also, if you
need a news ticker, make sure you have news to show.

Following on from these... if you absolutely must use one...

4. Make it as smooth/non-flickery as possible.
5. Make the speed quite slow.
