clickable radio buttons, a Section 508 issue?

Hello,
I've encountered a scenario where a webpage has a set of radio buttons that
use the onClick event to trigger a submit of the form which in turn updates
the page to display other fields to complete depending upon which radio
button is selected. Its sort of rudimentary Ajax.
There are two radio buttons, and upon selecting one the submit function is
done and the page reloads. Keyboard users (and screen reader users) are
placed back at the top of the page.
It is without question a usability issue for keyboard users.
However, my question is: is it a Section 508 issue under the current
guidelines for either 1194.22(l) or 1194.21(a)?
