It depends on the jurisdiction but most countries that are party of Marrakesh Treaty allow authorized organizations on behalf of people with disabilities to make accessible versions of the work under international copyright law.

Hello everyone,

I hope this is the right forum for my question below.

At Angelo State University, faculty have been recently introduced to Ally, a Blackboard tool that checks the accessibility of files included in online courses.

A lot of files used by faculty in their Bb courses are PDFs downloaded over the years from various library databases. Ally is failing most of these files, particularly in the Tags, Alt Text, Tab order, Title, Tables, Headers, and Language fields.

Since our faculty are not the copyright holders of these files, are they allowed to remediate them or change their format to make them accessible?

I am grateful for any feedback you can send my way as more and more faculty are wondering how to handle non-accessible third-party content in their Blackboard courses.

For any universities out there that have already instituted specific policies and/or have procedures in place to address this issue, would you be willing to share your documentation with me?
