Failing 13.2 - language meta data

I am using CynthiaSays and checking for Priority 1,2,3. I am failing on 13.2 even though I have:
<html xmlns="http://www.w3.org/1999/xhtml" lang="en-US">
and
<meta http-equiv="content-language" content="en" />
Does anyone know if this is a CynthiaSays bug, or have I don't something wrong?
