Paul,
The issue of the legend not being read is being observed on the iPhone
using iOS V8.2. Swiping right, the fieldset is read, legend is
completely ignored.
For an example try the WebAIM page
http://webaim.org/techniques/forms/controls and look at the radio
buttons section.
