I agree with Patrick. Though I'd never design a site that has an
"automatic" popup like the op describes. Sometimes one must bow to he who
signs the paycheck, but also sometimes he who signs the paycheck can be
persuaded that his approach could lead to more problems than it's worth.
For example, I've had many a customer tell me the "it's too costly (in
either time or money) to make my site accessible" to which I usually
respond (very politely of course), "Ok, so how expensive *is* a lawsuit
these days?" Citing cases where companies have had to pay out on
multi-million dollar lawsuits and STILL make their sites accessible.
