My first inclination was to say 2.4.6 because if heading elements are used for styling purposes, then it would follow that the heading does not describe topic or purpose. However, there is a specific failure for 1.3.1 Info and Relationships about this very topic. It states:
"The objective of this technique is to describe a failure that occurs when structural markup is used to achieve a presentational effect, but indicates relationships that do not exist in the content."
