Does incorrect heading use violate WCAG 2.4.6 or just 1.3.1?

If you are reporting conformance with WCAG success criteria, then when
content is incorrectly marked up as a heading, as when just used for
styling purposes, for instance, do you say it just violates 1.3.1 Info and
Relationships

or do you also ding it for failing 2.4.6 Headings and Labels

My understanding of 2.4.6 is that it is really is just addressing whether
the heading or label that is being used describes the topic or purpose, not
whether or not a heading is the right markup. Still, if the text is
incorrectly marked up as a heading then, ipso facto, that heading is not
going to really be correctly describing the topic or purpose. What do you
think?
