You can argue it under 2.4.3 (focus order is not necessarily logical
if you can focus non-interactive elements). It's a bit of an pen
interpretation (people can say the focus order is still logical).
You could also kind of fail it under 4.1.2, all interactive elements
must have a role .. but again being focusable does not mean the
elementis interactive.
I wish WCAG was much clearer on this issue, because it is, at the end
of the day, a huge usability issue (well, the size of the issue
depends on the number of focusable static elements).
But it causes confusion for the user if you can focus something you
can't interact with, and causes frustration for users if you end up
with a lot of elements you have to tab thorugh to get to the elements
you want to interact with.
