Personally, I didn't think my colleague's form control could be considered Section 508 compliant as/is. With the valuable feedback that I've gotten from you all here, I hope to be able to persuade this individual to add the fieldset to those checkboxes.

Jared, I agree. I think if you got down to the nitty gritty in court, you could probably argue and win the 508 violation case.
