I just meant that it's outside the document main content. An <aside> is by definition considered separate from that content. So if you have a page like:
H1 Page Title
H2 Important Heading
H3 Less important heading
What level should be the first header in <footer> and <aside>? The Headings in the <footer> and <aside> aren't directly related to the content on the page, so you can't compare importance levels.
