This is quite a common scenario. I regard it as a non-conformance for the same reason we regard the use of a placeholder as the label for a textbox to be a non-conformance. Once any data has been entered, the form control no longer has a visible label.

Hi folks,
I have 2 dropdown where you can choose your Date of Birth with all the dropdown are having its first value as the label of the dropdown.
Example : Choose your birth day is the first dropdown list value for the Date dropdown.
Does this fail WCAG Labels or Instructions? Since I choose any value other than the first one which is the label then the dropdown will change to the chosen Date/Month/Year.
