Hi All!

In order to make a website compliant with 'Chapter 206' and 'Chapter 213'
of Texas Administrative Code, would it be sufficient to abide by WCAG 2.0
or the website need to compliant with Section 508?

We try to use WCAG 2.0 to comply with Section 508, specific to 1194.22 Web-based intranet and internet information and applications, with a few exceptions. We try to map TAC 206.70/Section 508 to WCAG 2.0 in the attached documents.

We follow Section 508 to comply with TAC 213, with a few exceptions regarding video and multimedia products.

By policy at Texas HHS agencies we consider compliance with WCAG 2.0 AA to meet or exceed the requirements of Section 508. All new projects are required to comply with WCAG 2.0 AA.

In other words, can we assume if the state agency websites are compliant
with WCAG 2.0, those will be compliant with Chapter 206 and 213. Is that
correct?

TAC 206.70 (a) – (c) Accessibility requirements primarily mirror federal Section 508 §1194.22 (a) – (p) technical standards with two exceptions at this time. TAC requirements 206.70 (b) and (c) are modifications of Section 508 §1194.22 (b) and (k) respectively.

The TAC 213.32 (1) standard for Video and Multimedia Products mirrors the Section 508 §1194.24 (b) technical standard, and the TAC 213.32 (2) standard is modified from the Section 508 §1194.24 (c) – (e) technical standards at this time.

My understanding is that if a website meets TAC 206.70, and TACs 213.30, 213.32, 213.35, and 213.36, then it meets TAC 206 and 213 accessibility requirements for a website.

But, when the Section 508 refresh is released, Texas will likely adopt the refreshed requirements. That is why many Texas agencies and higher education institutions are moving to WCAG 2.0 level AA as the current compliance requirement for websites.

Additionally, under the Equivalent Facilitation clause of Section 508 if
you can meet the requirements in any other way, such as WCAG 2, it is
allowed, as long as it provides greater or equal access. The US Access
Board recognizes and promotes this view.

I'm not a lawyer, nor expert in 508 or Texas law. But as far as I can
tell, meeting WCAG 2 double A covers all the things you need to do for
both. (Although IMHO there are things you still need to do - not
complicated, mostly logical but missed in the attempts to provide legally
solid wording - to provide real accessibility).

The Texas Department of Information Resources made a recommendation in August of 2013 and directed to all Texas agencies / institutions of higher education to begin using WCAG 2.0AA as the technical standard for new website and web application development.
