It's Now Easier to Remove Federal Employees with Disabilities.


The Merit Service Board concluded that a federal agency could remove an
employee based on their medical condition if it could prove either a
connection between the employee's medical condition and their performance or
misconduct, or "a high probability that their condition may result in injury
to [them]self or others." Although the agency had found no fault with the
employee's past or current performance, it removed the employee based on its
assumption about their medical condition.
