Deserves in which sense? Just because it is a top-level heading in the
context of a section does not mean it "deserves" to be H1. Over the
centuries, such headings have been regarded as 2nd, 3rd, etc., level
headings, according to the nesting og sections.

Almost all current user agents deal with an H1 element as the top-level
heading of the page. Any claims to the contrary need hard evidence, as
this has been the meaning and treatment of H1 since the early days of
the web.
