Like Brandon, I like mine to be links as well-- esp in this case where the same footnote can be referred to several times, I may not need to re-read it several times in a row or anything.

I like the idea of using a modal for the problem if getting back to where you were. Sounds like one of the few times a modal dialog actually isn't superfluous design woo.
